Welcome to COVENANT. These Terms & Conditions (“Terms”) govern your access to and use of the COVENANT website, online store, products, services, and related features (collectively, the “Services”).
Throughout these Terms, “COVENANT,” “we,” “us,” and “our” refer to the business operating the COVENANT brand and website. “You” and “your” refer to any visitor, customer, or user of our Services.
By accessing our website, creating an account, joining our mailing list, placing an order, or otherwise using our Services, you agree to these Terms.
If you do not agree to these Terms, please do not use our Services.
1. ABOUT COVENANT
COVENANT is a Christian apparel and lifestyle brand creating faith-inspired clothing and merchandise.
Our products may incorporate biblical themes, Scripture references, Christian symbolism, original artwork, typography, and other faith-based creative elements.
Product availability, designs, colors, pricing, materials, and specifications may change from time to time.
2. ELIGIBILITY
By using our Services or placing an order, you represent that you are legally capable of entering into a binding agreement or that you are using the Services with the permission and supervision of a parent or legal guardian.
You agree to provide accurate, current, and complete information when placing an order or otherwise interacting with our Services.
3. PRODUCTS AND PRODUCT REPRESENTATION
We make reasonable efforts to display our products accurately.
However, colors, textures, sizing, print placement, embroidery, garment appearance, and other characteristics may vary slightly from photographs, digital mockups, or what appears on your screen.
Differences may result from:
- Screen and display settings;
- Manufacturing tolerances;
- Garment sizing variations;
- Fabric characteristics;
- Printing or embroidery processes;
- Dye lots;
- Product supplier changes; or
- The handmade or individually produced nature of certain items.
Such reasonable variations are not necessarily considered defects.
Please review all available product descriptions and sizing information before ordering.
4. ORDERS
Submitting an order does not necessarily mean that we have accepted it.
We reserve the right to refuse, cancel, limit, or modify an order where reasonably necessary, including because of:
- Product availability;
- Pricing or listing errors;
- Suspected fraud;
- Payment issues;
- Shipping restrictions;
- Technical errors; or
- Other circumstances that prevent us from reasonably fulfilling the order.
If we cancel an order after payment has been collected, we will refund the amount paid for the canceled portion of the order.
5. PRICING AND PAYMENT
Prices are displayed in U.S. dollars unless otherwise stated.
Applicable taxes, shipping charges, and other fees will be shown during checkout when required.
Prices and promotions may change without notice. A price change will not normally affect an order that has already been accepted.
You authorize us and our payment processors to charge the payment method provided for your order.
We do not directly store complete payment-card information when payment processing is handled by a third-party payment processor.
6. PRE-ORDERS
Certain COVENANT products or collections may be offered through pre-order.
A pre-order means you are purchasing an item before it is ready for normal shipment.
Estimated production and shipping dates are estimates and are not guaranteed delivery dates.
Production schedules may be affected by garment availability, printing, embroidery, fulfillment partners, carriers, supply-chain delays, weather, or other circumstances outside our reasonable control.
If a significant delay occurs, we may provide updated information using the contact information associated with your order.
By purchasing a pre-order item, you acknowledge that fulfillment may take longer than an ordinary in-stock purchase.
Any cancellation or refund rights applicable to a pre-order will be governed by our posted Return & Refund Policy and applicable law.
7. PRINT-ON-DEMAND AND MADE-TO-ORDER PRODUCTS
Some COVENANT merchandise may be produced specifically after an order is placed through COVENANT or one of our production and fulfillment partners.
Because garments may be individually printed, embroidered, or otherwise produced, minor variations in print placement, dimensions, garment color, or appearance may occur.
These variations are a normal part of apparel production unless the product is materially defective or materially different from what was ordered.
8. SHIPPING AND DELIVERY
Shipping estimates are provided for convenience and are not guaranteed unless expressly stated otherwise.
Once an order is transferred to a shipping carrier, circumstances outside our control may affect delivery.
Customers are responsible for providing an accurate and complete shipping address.
If an order is returned because an incorrect or incomplete address was provided, additional shipping charges may apply before the order can be resent.
Risk of loss and legal title to merchandise will transfer as provided by applicable law and the terms governing the applicable shipment.
International customers, if international shipping is offered, may be responsible for customs duties, import taxes, brokerage fees, or other charges imposed by the destination country.
9. RETURNS, EXCHANGES, AND REFUNDS
Returns, exchanges, replacements, and refunds are governed by the COVENANT Return & Refund Policy in effect at the time of purchase.
Please review that policy before placing your order.
Nothing in these Terms limits any refund, return, warranty, or consumer-protection rights that cannot legally be waived.
10. DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS
If you receive an item that is damaged, materially defective, or different from the product you ordered, please contact us promptly using the contact information provided on our website.
We may request photographs or other reasonable information to verify the issue and assist with a replacement, refund, or other appropriate resolution.
Normal wear and tear, improper laundering, misuse, accidental damage, or failure to follow garment-care instructions are not considered manufacturing defects.
11. GARMENT CARE
Customers are responsible for following the care instructions provided with their garments.
Printing, embroidery, fabric, and garment appearance may deteriorate if products are washed, dried, ironed, treated, or stored contrary to the provided care instructions.
COVENANT is not responsible for damage resulting from improper garment care.
12. INTELLECTUAL PROPERTY
Unless otherwise indicated, the COVENANT brand identity and original content available through our Services—including original designs, graphics, artwork, photographs, logos, product names, slogans, layouts, website content, and other creative materials—are owned by or licensed to COVENANT and are protected by applicable intellectual-property laws.
You may not reproduce, manufacture, copy, distribute, sell, modify, commercially exploit, or create unauthorized derivative products from our protected materials without written permission.
Purchasing a COVENANT product does not transfer ownership of the intellectual-property rights associated with its design.
13. SCRIPTURE AND THIRD-PARTY CONTENT
COVENANT products may contain quotations, references, adaptations, or excerpts from Scripture.
Individual Bible translations may be subject to separate copyrights, trademark rights, attribution requirements, or quotation policies maintained by their respective publishers or rights holders.
Where required, COVENANT will seek to comply with applicable permissions, attribution requirements, and usage policies.
References to third-party works, organizations, trademarks, or materials do not necessarily imply sponsorship, affiliation, or endorsement.
14. COVENANT TRADEMARKS AND BRANDING
The COVENANT name, logos, brand marks, original slogans, product branding, and other source-identifying materials may constitute trademarks or other protected intellectual property.
Nothing contained in the Services grants you permission to use COVENANT branding in connection with another business, product, website, social-media account, or commercial activity without our written permission.
15. CUSTOMER CONTENT, REVIEWS, AND PHOTOS
If you voluntarily submit a product review, photograph, testimonial, social-media content, or other material to COVENANT, you represent that you have the right to submit that material.
Where you expressly authorize us to use submitted material for marketing or promotional purposes, you grant COVENANT a non-exclusive, worldwide, royalty-free license to reproduce, display, distribute, and use that material for the authorized purposes, subject to applicable law.
We will not knowingly claim ownership of your original content merely because you submitted it to us.
16. PROMOTIONS AND DISCOUNT CODES
Promotions, giveaways, discounts, referral programs, early-access offers, and promotional codes may be subject to additional terms.
Unless otherwise stated:
- Promotional offers cannot be redeemed for cash;
- Discounts cannot be combined where prohibited by the promotion;
- Codes may have expiration dates or usage limits; and
- We may cancel promotions affected by fraud, abuse, or technical errors.
17. EMAIL AND MARKETING COMMUNICATIONS
If you voluntarily subscribe to COVENANT marketing communications, you may receive product announcements, collection launches, pre-order notices, promotions, brand stories, and other marketing communications.
You may unsubscribe from marketing emails using the unsubscribe mechanism included in those communications.
Transactional communications concerning purchases, shipping, account security, or customer service may still be sent when necessary.
18. ACCEPTABLE USE
You agree not to misuse our website or Services.
You may not knowingly:
- Attempt to gain unauthorized access to our systems;
- Introduce malicious software;
- Interfere with website operation;
- Scrape or harvest information in violation of applicable law;
- Use our Services to commit fraud;
- Impersonate another person;
- Violate intellectual-property rights; or
- Use our Services for unlawful purposes.
We may restrict access to the Services where reasonably necessary to protect COVENANT, our customers, or third parties.
19. THIRD-PARTY SERVICES
COVENANT may use third parties for services including payment processing, website hosting, analytics, email communications, printing, manufacturing, fulfillment, and shipping.
Those third parties may have their own terms and privacy practices.
COVENANT is not responsible for independently operated third-party websites or services except to the extent required by applicable law.
20. WEBSITE AVAILABILITY
We strive to maintain reliable access to our website but cannot guarantee that the Services will always be uninterrupted, secure, or error-free.
We may modify, suspend, maintain, or discontinue portions of the Services when reasonably necessary.
21. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, the Services and website are provided on an “as is” and “as available” basis except for warranties expressly provided by COVENANT or warranties that cannot legally be disclaimed.
We do not warrant that the website will always be uninterrupted, error-free, or free from harmful components.
Nothing in these Terms excludes warranties or consumer rights that cannot be excluded under applicable law.
22. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, COVENANT and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or purchase of products.
Where permitted by law, COVENANT's total liability arising from a particular purchase will not exceed the amount you paid to COVENANT for the product or order giving rise to the claim.
These limitations do not apply where liability cannot legally be excluded or limited.
23. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold COVENANT harmless from third-party claims, damages, liabilities, and reasonable expenses arising from your unlawful misuse of the Services, infringement of another party's rights, or material violation of these Terms.
24. GOVERNING LAW
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where applicable federal law or mandatory consumer-protection law provides otherwise.
25. DISPUTES
Before initiating formal legal proceedings, you and COVENANT agree to make a good-faith effort to resolve disputes informally by contacting the other party and providing a reasonable opportunity to address the matter.
Nothing in this section prevents either party from pursuing rights or remedies available under applicable law or from bringing an eligible matter in small claims court.
26. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, products, Services, or legal obligations.
The updated version will be posted with a revised “Last Updated” date.
Changes will apply prospectively unless applicable law permits otherwise.
27. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
28. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any additional terms presented during a particular transaction, constitute the applicable agreement between you and COVENANT concerning your use of the Services and purchases from us.
